Stage by stage

  1. Title check

Before buying, verify the chain of title, revenue records and encumbrances.

    Transfer of Property Act, 1882

  2. Sale deed and registration

Ownership of immovable property passes by a registered sale deed (s.54 TPA). A sale cannot be completed merely by a GPA/agreement-to-sell/will arrangement. Genuine testamentary succession and a duly authorised attorney executing a conveyance are distinct; a will operates on death, subject to applicable succession law.

Suraj Lamp & Industries Pvt. Ltd. v. State of Haryana, (2012) 1 SCC 656, Supreme Court of India, decided 11.10.2011 · Transfer of Property Act, 1882

  3. Lease and notice

A lease is defined in s.105 TPA; termination notices are governed by s.106 unless the contract or a local law provides otherwise.

    Transfer of Property Act, 1882

  4. Chandigarh tenancies (2026)

The official Gazette No. 102 of 10 September 2026 contains Notification No. 617902/UTFI(I)/2026/8918 making the Union Territory of Chandigarh Tenancy Rules, 2026 under the Assam Tenancy Act, 2021 as extended to Chandigarh. Rule 1(3) brings the Rules into force on Gazette publication. The governing forum and treatment of existing tenancies or pending cases require the extended Act, transitional provisions, appointments and any operative court order; a news report alone does not establish those matters. Read the official Gazette copy.

  5. Disputes

Possession, partition and injunction suits go to civil courts; tenancy disputes go to the forum under the applicable tenancy law.

Frequently asked questions

Does a GPA sale give me ownership?

A GPA-sale arrangement does not convey ownership in place of a registered conveyance. Suraj Lamp preserves genuine agency arrangements; succession under a valid will is a different legal route and operates on death.

Which tenancy law applies in Chandigarh now?

The Chandigarh Tenancy Rules, 2026 were published in the official Gazette on 10 September 2026. For a particular dispute, check the extended Act, transitional provisions, competent forum and any operative court order; the newspaper report is secondary background.
